<li><span><strong>According to a 2008 Chicago Law School study, the Oregon Courts are next to the worst in the nation.*</strong></span></li>
<li><span><strong>Oregon Chief Justice Paul De Muniz is retiring after only one term leaving behind a huge mess known as the Oregon eCourt fiasco.*</strong></span></li>
<li><span><strong>Oregon judges do not know the law when it comes to foreclosure in Oregon courts.*</strong></span></li>
<li><span><strong>Oregon courts have been slow to react to the &lsquo;tsunami&rsquo; of foreclosure cases before them.* &nbsp;</strong></span></li>
<li><span><strong>Oregon lawyers like lawyers around the United States are engaging in the rampant filing of fraudulent documents in state and federal courts.*</strong></span></li>
<li><span><strong>The foreclosure mess is not even half over.*</strong></span></li>
<li><span><strong>Bank of America ensures they play all sides of the foreclosure bets by sponsoring Oregon&rsquo;s Legal Aid Service, the Legal Services Corporation, the Oregon State Bar, the Multnomah County Bar Association, the American Judicature Society and probono.net, all in a blatant legal subterfuge.&nbsp; The scale of this fraud on the American public goes all the way to Lewis Powell&rsquo;s 1971 memo to the Chamber of Commerce.&nbsp; It is but one vehicle that has enabled Oregon judges to ignore the Rule of Law.*</strong></span></li>
<li><span><strong>Oregon judges are, by the Oregon Constitution required to be elected.&nbsp; Oregon Constitution Article VII (Amended), Section 1&nbsp; They aren&rsquo;t.&nbsp; &nbsp; 75% of Oregon judges are appointed.&nbsp; As soon as Governor Kulongoski&nbsp; was elected, he conspired with the Oregon State Bar Board of Governors to corner judicial appointments and subvert the Oregon Constitution. I should know, I was on the Board of Governors of the Oregon State Bar in 2002 when he did this.*&nbsp;</strong></span></li>
<li><span><strong>The Oregon Supreme Court is required to formally report annually to the Oregon Governor and Legislature following their annual Judicial Conference.&nbsp; ORS 1.840&nbsp; They don&rsquo;t.&nbsp; </strong></span><span><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</strong></span></li>
<li><span><strong>Worse, the annual Oregon Judicial Conference IS SECRET even though under Oregon&rsquo;s Constitution all court matters are required to be public.&nbsp; Oregon Constitution Art I, Section 10</strong></span></li>

<p><span><strong>Now, do you understand why Chief Justice Paul De Muniz is retiring after only one term.&nbsp; Surely, it has nothing to do with his former partner, John Hermann being on Oregon&rsquo;s Public Compensation Commission which determines judge&rsquo;s salaries.* &nbsp;</strong></span></p>

<p><span>Pug Goes Wandering with Occupy Portland</span></p>
<p><span>&nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Pug&rsquo;s camera shots were in black and white.&nbsp; For some reason&nbsp;</span>Pug was focused on the bronze statue of The Pioneer that sits on top of the Oregon Capitol Building.&nbsp; The current iteration of Oregon&rsquo;s political mecca was&nbsp; built circa 1938 after the former structure burned in 1935.&nbsp; The&nbsp; year of these black and white photos of Oregon&rsquo;s capitol was 1957 and Pug was on a field trip&nbsp; with his seventh grade class. &nbsp;</p>
<p><span><span> </span>Pug&rsquo;s last trip to Salem was on February 1, 2012.&nbsp; This time it was an Occupy Portland field trip to talk with the Guv.&nbsp; The trip began with Uta&rsquo;s beaming smile as she handed plates of a delicious hot breakfast through the open bus windows while it was parked in front of Mayor Sam Adam&rsquo;s place of business.&nbsp; The bus was full, the occupants eager.&nbsp; With Joe at the wheel we were ready for our mission.&nbsp; Weather favorable.</span></p>
<p><span><span> </span>Unloading directly in front of the capitol building an hour later, the site was at once redolent and contrasting.&nbsp; On one side were our fellow Occupiers who had assembled from around the state and locally to support the Occupier mission. &nbsp;</span></p>
<p><span><span> </span>Then on the other side of the parking mall there were massive motorcycles of a conclave of bikers there on a similar lobbying mission.&nbsp; Of course, there stood the obligatory Oregon State Police in groups of three everywhere with muscular folded arms crossed in front of their flak tested chests.&nbsp; Later, I learned from an unsuspecting (that I was an Occupier) capitol employee that they put on the extra flat hats for us.&nbsp; They were anticipating a violent intrusion of Occupiers at the 8:30 a.m. gaveling of the new legislative session in the stately chambers, not realizing we were just loading onto our bus in Portland about then. &nbsp;</span></p>
<p><span><span> </span>Upon the Salem arrival, the Occupiers disbursed in all directions in the sophisticated surroundings.&nbsp; Pug had a mission on the subject of&nbsp; an Occupier Issue Report he had compiled from Occupier protest signs. Pug was also there on the subject of foreclosure, a legislative favorite.&nbsp; So, Pug went dutifully to his representative&rsquo;s offices which are conveniently located in floors one thru four inside.&nbsp; Happily, Pug was waved into the Senator Mark Hass office with nary an introduction by his staff.&nbsp; He was distractedly welcoming and cheerfully accepted Pug&rsquo;s handouts.&nbsp; It is now several days later, and he has not called Pug on the rich material Pug provided him regarding the above subjects.&nbsp; Do you suppose he will read the twenty pages?&nbsp; And act on them without further prodding?</span></p>
<p><span><span> </span>Pug got the same welcoming treatment from Senator Betsy Johnson&rsquo;s and Representative Jeff Barker&rsquo;s staffs.&nbsp; Each has an &lsquo;IN&rsquo; basket located immediately outside their office, so it is convenient to drop off any message one wants to at any state politician office in the building.&nbsp; Then the rule is, never send out a flyer without following it up with a telephone (or personalized E-mail) call.&nbsp; That is the wisdom Barry Menasche, local real estate mogul, taught Pug many years ago. &nbsp;</span></p>
<p><span><span> </span>In the pleasant afternoon, there was a gathering with the Guv who gave Occupy a brief seance.&nbsp; Then Pug went off to a GA in a nearby coffee shop with the surrounding town Occupiers.&nbsp; Pug&rsquo;s conversation with one Salem Elder revealed the same boom and bust pattern is happening there as in Portland.</span></p>
<p><span><span> </span>Joe then piled us on the bus about 7 p.m. for our return to Sam&rsquo;s place.&nbsp; Whereupon, as we pulled up to the vigil, we were entertained with a lengthy mesmerizing poem by an Occupier who then released us into the night.&nbsp; Mission accomplished.&nbsp; O.K., O.K., it is a start anyway.&nbsp; Follow-up is the key. &nbsp; What a pleasant day. &nbsp;</span></p>

<p><span>When a homeowner defaults on their loan, there are a number of &lsquo;T&rsquo;s that must be crossed and &lsquo;I&rsquo;s that must be dotted by the lender BEFORE a foreclosure can take place.&nbsp; Normally, the bank would arrange for that &lsquo;straw person&rsquo; to be identified, ie., the Trustee who will conduct the foreclosure sale on the courthouse steps.&nbsp; RCO has all these companies under their corporate umbrella (AND more as we shall see).&nbsp; Then they need a title report to ensure their&nbsp; interests are protected. &nbsp;</span></p>

<p><span><span> </span>One can easily forget the tidal wave of carnage powerful men have left in their wake in between.&nbsp; This misuse of male power kills.&nbsp; I know for I have looked it in the eye.&nbsp; I know because Neil Goldschmidt, I hardly knew ya, but I seen what you done.&nbsp; To her.&nbsp; You had sex with her when she was barely a teenager and killed her soon thereafter.&nbsp; <a href="http://wweek.com/portland/blog-26366-elizabeth_lynn_dunham_may_12_1961_jan_16_2011.html">The dying didn&rsquo;t happen until this year, but Neil actually killed her long ago.&nbsp;</a> And maybe he even had sex with her corpse, figuratively speaking.&nbsp; &nbsp;</span></p>

<p><span><span> </span>In case it escaped your attention, Neil was the Mayor of Portland long ago, a one-term Governor; when Portland&rsquo;s newspaper began to figure it out, a powerful lobbyist and political maker on the make.&nbsp; He ended as President Carter&rsquo;s Cabinet member. &nbsp;</span></p>

<p><span><span> </span>All the while her life was in serial disarray and &ldquo;...things never really ended well for her.&rdquo; &nbsp;</span></p>

<p><span><span> </span>Senator Bob Packwood is every bit as homely as Kissinger. &nbsp; And similarly on the make.&nbsp; <a href="http://www.ajr.org/article.asp?id=2101">Once again, Oregon&rsquo;s newspaper hid his misdeeds so he could be reelected in 1992</a>.&nbsp; Then he put down a three year smokescreen to hold office until 1995. &nbsp;</span></p>

<p><span><span> </span>This time, I literally looked one of his victims in the eye and she was kind enough (with her husband&rsquo;s assent) to tell me a bit of her story.&nbsp; Her words do not matter AS MUCH AS WHAT I SAW.&nbsp; It is more about what I saw.&nbsp; <a href="http://en.wikipedia.org/wiki/Bob_Packwood">A severely wounded woman that history may forget, but I won&rsquo;t</a>. It is unclear what she would have become.&nbsp; It is unclear what Neil&rsquo;s victim would have become.&nbsp; My sense is both had unlimited potential, truncated by these powerful men.&nbsp; Both were ruined by selfish, uncaring egotistical monsters.&nbsp; Monsters. &nbsp;</span></p>

<p><span>Standing <strong>in that one spot</strong>, on a cold Fall Sunday,&nbsp; I could look at six leaders who are liars.&nbsp; Former Senator Mark Hatfield.&nbsp; Former President William Clinton.&nbsp; Should be-former Mayor, Sam Adams.&nbsp; Portland, Oregon Police Chief Mike Reese.&nbsp; U.S. District Court Judge Marco Hernandez. &nbsp; Chief Judge Ann Aiken.</span></p>
<p><span>&nbsp;</span></p>
<p><span>The place is Fourth and Salmon in downtown Portland, Oregon.&nbsp; I was following the Occupy Portland rally to Portland&rsquo;s waterfront.&nbsp; It was cold and the previous day&rsquo;s storm had blown down many of the remaining leaves over Lownsdale and Chapman Park. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span>I don&rsquo;t know why, but I was drawn to the cyclone fence our leaders have put up around these two commodious parks in an important part of town.&nbsp; The fence even has barbed wire on top to keep the motley crowd from stealing any of those beautiful gold leaves.</span></p>
<p><span>&nbsp;</span></p>
<p><span>There was a soft breeze. &nbsp;Three police clomped by on their Clydesdales.&nbsp; Going nowhere, all of us. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span>But, this is an important issue&nbsp; --&nbsp; the truth.&nbsp; Truth in important part of town:</span></p>
<p><span>&nbsp;</span></p>

<li><span><span style="white-space: pre;"> </span>There it is.&nbsp; A sixteen floor building of dubious architecture.&nbsp; You know the building I mean;&nbsp; the one with the odd hat.&nbsp; There is more odd about it, but that for another time.&nbsp; I am speaking of the U.S. Courthouse with Mark Hatfield&rsquo;s name on it.&nbsp; He was found guilty of accepting gifts and accepting money for his wife&rsquo;s no work job&nbsp;</span>from a criminal.&nbsp; You&rsquo;ll find her name on a theater thereabouts.&nbsp; Why do liars get their names put on buildings?&nbsp; Clinton&rsquo;s name is on the corner courthouse stone circa 1997.&nbsp; Two liars in positions of authority.</li>
<li><span>&nbsp; &nbsp; &nbsp; &nbsp; Sam Adam's building is close by.&nbsp; Mike Reese&rsquo;s building next door. &nbsp; Two liars in positions of authority.&nbsp; Their lies are now well known.&nbsp; Sam about criminal-sex.&nbsp; Mike about Occupy Portland.</span></li>
<li><span>&nbsp; &nbsp; &nbsp; &nbsp;<a href="http://www.bulletinsfromaloha.org/weekly/2008/4/23/judicial-elections-do-you-know-who-the-candidates-are-at-you.html"> Marco Hernandez</a> lied about a contentious case he was judging, just because he could.&nbsp; He got rewarded for that lie as our U.S. Senate Judiciary Committee just turned away.&nbsp; Ann Aiken lied about the Rule of Law and all others there and in the Ninth Circuit also just turn away.&nbsp; It is about foreclosures in America where an awful, awful big lie is going down right now. &nbsp;</span></li>

<p><span>Lying by our leaders is not just happening at the corner of Fourth and Salmon St. in Portland.&nbsp; In fact, Eric Alterman wrote a complete book about some of the more momentous lies told by U.S. Presidents in his book <em>When Presidents Lie</em>. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span>Just tell the truth.&nbsp; It works.&nbsp; It works fine.&nbsp; Now, I turn away to &nbsp;join those in Occupy Portland.&nbsp; But, I will never look at that intersection at Fourth and Salmon St., in Portland the same again.&nbsp; Four buildings full of liars.&nbsp; The U.S Courthouse, the Justice Center, City Hall and Multnomah County Courthouse.&nbsp; All right there.&nbsp; Full of liars.&nbsp; And the ragtag don&rsquo;t even get to pick up the golden leaves in their own park at 4th and Salmon.&nbsp;</span></p>

<p><span><span> </span>It was a small bedroom community peopled by World War II vets and innocent housewives.&nbsp; Lurking in their midst is a gay child abuser.&nbsp; He was about 50 years old and a janitor at a General Motors distribution plant. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>His primary bait was milk and cookies that ten (10) year-0ld boys didn&rsquo;t necessarily have access to in their own blue-collar homes.&nbsp; Consequently, there was an obvious beaten path from the local grade school to his home. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>What was odd, and a dead give-away, was that his only sibling, his brother, would not traffic with him.&nbsp; Odd, because the brother lived only three doors away.&nbsp; Roy&rsquo;s home was a one-bedroom affair located in a working-class suburban &lsquo;hood&rsquo;.</span></p>
<p><span>. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Roy&rsquo;s approach was at once simple and sophisticated.&nbsp; Sophisticated because Roy knew that his first prophylactic at being caught was grooming his victim&rsquo;s parents.&nbsp; He was hardly subtle at this approach.&nbsp; He would make it his business to meet the victim&rsquo;s&nbsp; parents which served as an after-burner to his abuse. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Should local society have been more alert? Yes.&nbsp; It is unfathomable that the community did not notice the steady stream of young boys to Roy&rsquo;s doorstep.&nbsp; So it goes at Happy Valley Pennsylvania.&nbsp; People know.&nbsp; They just advert their knowing eyes to raise their roses and go water skiing.</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Roy took his victims on overnight fishing trips to the coast.&nbsp; When he checked into the sleazy motels, he specifically requested of the desk clerk a single bed.&nbsp; Huh?&nbsp; Why is a 50 year old man wanting to sleep with a young boy in one bed?&nbsp; Even if the clerk supposed they were father and son, wouldn&rsquo;t a storm flag be obvious.&nbsp; The other red flag was Roy&rsquo;s choice of colors on his almost new car&nbsp; --&nbsp; purple.&nbsp; Parked in front of a one bedroom shack. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>The Polaroid-Land camera was the digital camera de jour and vehicle to capture his victim&rsquo;s visage for his extended sick purposes. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>No one ever reported these multiple, multiple abuses to the authorities over a fifteen (15) year period.&nbsp; The only thing that stopped it was Roy&rsquo;s early death through a heart attack.&nbsp; This is also a Catholic community.&nbsp; Society has done a terrible job at protecting young boys from an onslaught of sexual abuse.&nbsp; Vigilance has to replace caution.&nbsp; Active reporting is required.&nbsp; Suspicions must be reported.&nbsp; Where there is smoke there is a pedophile.&nbsp; No one ever gets over sexual abuse. &nbsp;</span></p>

<p><span>As president of the local bar association, my mission was to attenuate an important dispute between the presiding judge and local lawyer Terry Hall.&nbsp; The issue was courthouse security.&nbsp; Terry wanted to be able to &lsquo;pack&rsquo; when he went to court.&nbsp; In making the argument to me, he lamented that &ldquo;....the nerds have taken over the courthouse....&rdquo;, referring to then-presiding county judge Gayle Nachtigal.</span></p>
<p><span>&nbsp;</span></p>
<p><span>As to his major thesis, whether the nerds have, indeed, taken over the courthouse, I had not given much thought. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span>Right now, it is clear that the nerds have taken over the U.S. Senate.&nbsp; A moments attention taken to either Harry Reid, leader of the Dems or Mitch McConnell, leader of the Repubs makes the case.&nbsp; Watching them carefully in this latest &ldquo;jobs&rdquo; debate and the &ldquo;occupy&rdquo; movement discloses two nerds who don&rsquo;t have a clue.&nbsp; I don&rsquo;t think either one can relate to the common citizen and what is going on in America.</span></p>
<p><span>&nbsp;</span></p>
<p><span>So, it is at the local court near you.&nbsp; For the next ten years after Terry Hall&rsquo;s utterance, I began to watch the situation at the local courts.&nbsp; Soon, I was taking an unscientific, nonobjective poll.&nbsp; The question posed to local lawyers was simple.&nbsp; Since <a href="http://www.bulletinsfromaloha.org/weekly/2009/6/13/judicial-performance-evaluations.html">the state legal profession's leadership has rejected the call to have formal judicial evaluations,</a> my informal poll was all there is.&nbsp; The Oregonian used to make an annual objective evaluation of the local judiciary, but has abandoned the field.</span></p>
<p><span>&nbsp;</span></p>
<p><span>My poll asked this: &nbsp; Given what you were told in law school about what to expect from judges, how would you rate the actual local judiciary you have to deal with every day, on a scale of 1---to ---10.&nbsp; 1 being the worst.&nbsp; 10 being next to god.&nbsp; The result was a consistent &ldquo;2&rdquo;.&nbsp; Thus, Local Lawyers regard their judges as terrible.&nbsp; This result is&nbsp; borne out in a 2008 formal, objective study by the Chicago Law School of the Oregon appellate courts.&nbsp; This study rated Oregon courts absolutely at the bottom of the barrel. &nbsp;</span></p>

<p><span>In short, the nerds have taken over the local court houses.&nbsp; It is not pretty.&nbsp; First, they have a chip on their shoulder.&nbsp; Second, they resist the call of the iconoclast in their presence. <a href="http://www.bulletinsfromaloha.org/weekly/2008/1/1/common-law-does-not-make-common-sense.html">That is, after all, what the common law is all about.</a>&nbsp;These insecure souls shudder at the truculent lawyer who asserts firmly the rule of law.&nbsp; Finally, they are weird.&nbsp; Take Gayle Nachtigal.&nbsp; She is a social misfit.&nbsp; She is unable to relate to the normal functioning of people in her workplace.&nbsp; She has sought refuge in right-wing organizations instead of helping ALL the citizenry in her courtroom.&nbsp; She ignores the rule of law in her quest to have revenge over those who made her uncomfortable as a nerd.&nbsp; This is but the tip of the iceberg among our local judiciary.&nbsp; There are few judges worth our respect.&nbsp;<a href="http://blogs.wsj.com/law/2010/06/15/does-the-rule-of-law-even-exist-in-the-us-anymore/"> There are few doing their job and few following the rule of law.</a>&nbsp; </span></p>
<p><span>That is the sad part of the dubious trend in our judiciary; locally and across the country. &nbsp;</span></p>

<p><span><span> </span>In this short time, it appears that your office has been busy.&nbsp; Congratulations on your Lighthouse mortgage fraud prosecution.</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Yet one of the most pervasive frauds in Oregon&rsquo;s mortgage market is flying just under everyone&rsquo;s radar.&nbsp; It is omnipresent.&nbsp; This fraud is being ignored by the judiciary for reasons, I suspect, that has something to do with banks providing direct and indirect funding to the judiciary and to associations within the judiciary.&nbsp; Clear fraud is occurring by and through Oregon lawyers and Oregon financial institutions on innocent Oregon homeowners in foreclosure.&nbsp; No one is doing anything about this illegal activity that I describe in the attached <em>Fraud Report on Bank of America. </em>&nbsp; The Oregon Department of Justice, your former posting, has been missing in action in this arena, notwithstanding my prodding.&nbsp; &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><strong>NATACHE&rsquo;S CASE</strong></span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Enclosed you will find an April 26, 2011 letter I sent to John Deits of your office which summarizes only one of these cases.&nbsp; I call it &lsquo;Natache&rsquo;s&rsquo; case.&nbsp; It is compelling.&nbsp; The fraud worked on her by Oregon attorney Ian Kyle is bad enough.&nbsp; If you will look below the surface you will find that Mr. Kyle works for a nationwide network of companies that know very well what they are doing. My detailed <em>Fraud Report </em>describes how this insidious process works for Bank of America and their progeny. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>As you peruse my information on Ian Kyle&rsquo;s law firm, Routh, Crabtree and Olsen, you should note that the fraud perpetrated on the court and the homeowner specifically described in my letter to Mr. Deits, is not inadvertent.&nbsp; The Routh law firm reports that they have handled over 100,000 foreclosures.&nbsp; Further, this Bank of America law firm states in their website that:</span></p>

<p><span><span> </span>and is fully....computerized to enhance efficiency </span><span><strong>AND&nbsp;</strong></span></p>
<p><span><strong>&nbsp;&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; </strong></span><span><strong>ACCURACY</strong></span><span>, hard copies and scanned images of </span><span><strong>ALL</strong></span></p>
<p><span><span> </span>pertinent documents are produced and readily available</span></p>
<p><span><span> </span>for instant review...to ensure completeness of the fore-</span></p>
<p><span><span> </span>closure.&rdquo;&nbsp; (Emphasis supplied)</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Federal Magistrate Judge Paul Papak did not deign to ask</span></p>
<p><span>Mr. Kyle how their law firm could have made such a devious error in filing his </span><span>false</span><span> documents that &lsquo;just happen&rsquo; to favor Bank of America.&nbsp; Given the meticulous standards his law firm purports to have with respect to the &ldquo;accuracy&rdquo; of their documents--------points to intentional fraud by them on the Court and on Natache. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>One must ask then, what about those other 100,000 foreclosure cases they have already handled and the millions yet to come?</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Everyone has ignored how Bank of America and others game the legal system on all sides of the legal process in the foreclosure pipeline.&nbsp; Natache&rsquo;s case is a textbook example on how this game works --&nbsp; for the banks, for their lawyers and silently against the Natache&rsquo;s of the world.&nbsp; &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>In my own case, which is &ldquo;on all fours&rdquo; with Natache&rsquo;s case; the creditor is represented by the Schwabe mega-law office.&nbsp; This law firm, which is also well connected, having recently hired retired Oregon Supreme Court Justice Michael Gillette, also knows well what it is doing.&nbsp; Like Natache&rsquo;s case, the judiciary is turning a blind eye to the blatant fraud of Schwabe attorney Craig Russillo just as they have done with Ian Kyle. &nbsp; Why?&nbsp; Because no one is looking.&nbsp; Oregon&rsquo;s judiciary at the local level and the judiciary at the Ninth Circuit level is actively looking the other way.&nbsp; In the case of the Oregon Supreme Court, I have caught them red handed in ruling on the substantive issues of my foreclosure case, <strong>WITHOUT THAT COURT EVER LOOKING AT THE RECORD NOR THE TRIAL COURT FILE.&nbsp; </strong>&nbsp; There are over 200 of these cases in your building.&nbsp; (Check the Justia law index report for foreclosures in the Oregon District.)&nbsp; In virtually all these cases you will learn that the lender illegally foreclosed when they had no legal right <em>nor constitutional standing </em>to do so.&nbsp; This is what seventeen (17) judges in my case have ignored.&nbsp; &nbsp; Mosey down the hallway and have Judge Garr King and Judge Anna Brown fill you in on the details in their cases on this same issue. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Then if you peel below the next layer, you will find that Bank of America, Merrill Lynch, Wells Fargo and other financial institutions are sponsoring various national legal entities such as the American Judicature Society, probono.net and an endless string of groups that are doing in the legal arena the exact same thing they all did in the financial arena&nbsp; --&nbsp; they play all sides of the bet.&nbsp; (See&nbsp; the recent book by a writer for The New York Times, Joe Nocera and Bethany McLean,&nbsp; <em>All the Devils are Here, </em>Penguin Press, 2010 on how this game is played on the major stages of Wall Street.) &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>The Multnomah County Bar Association is even funded by Merrill Lynch, a Bank of America subsidiary, on their soirees for local judges including Oregon Supreme Court Chief Justice, Paul De Muniz, most recently.&nbsp; This can be confirmed by going to their website. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>Thus, by sponsoring various legal trade associations, Bank of America and the others are securing the silence of&nbsp; judges like federal magistrate judge Paul Papak as to the open financial fraud perpetrated by lawyer Ian Kyle and Craig Russillo --&nbsp; openly in his courtroom and everywhere&nbsp; --&nbsp; top to bottom. &nbsp;</span></p>
<p><span>&nbsp;</span></p>
<p><span><span> </span>It is no accident that Justice De Muniz is retiring because I have caught him and the Oregon Supreme Court red-handed as described above.&nbsp; It is no accident that Oregon&rsquo;s Attorney General John Kroger is taking himself out of the game. He has been ignoring this vital issue of lender fraud for over three years&nbsp; --probably, because he wanted to run for governor before other scandals have overtaken him.&nbsp; I have formally written to him on this issue beginning over three years ago without result.&nbsp; No one is paying attention.</span></p>

<p><span>&nbsp;</span></p>
<p><span><span> </span>I hope you will.&nbsp; It is a long story.&nbsp; It is a multifaceted fraud.&nbsp; It is an important story.&nbsp; It is a compelling story.&nbsp; All the other players stand mute. Since 2004 there are probably tens of thousands of Oregon homeowners subject to the scam of banks foreclosing with fraudulent documents. &nbsp;</span></p>

<p><span><span> </span>Remember the lonely whistleblower of Madoff?&nbsp; The present fraud is no smaller in scope nor amounts.&nbsp; All one has to do is be curious.&nbsp; Few prosecutors have been curious. &nbsp;</span></p>
